VIOLATIONS DES DROITS FONDAMENTAUX DES PERSONNES INCARCÉRÉES EN RÉPUBLIQUE DÉMOCRATIQUE DU CONGO : CAS DU TERRITOIRE DE MBANZA-NGUNGU

Il ressort de l’article 18, alinéa 5, de la Constitution du 18 février 2006 telle que modifiée et complétée par la loi n° 11/002 du 20 janvier 2011, que tout détenu doit bénéficier d’un traitement qui préserve sa vie, sa santé physique et mentale ainsi que sa dignité. Ceci  réaffirme l’attachement de la République démocratique du Congo aux droits humains tels que proclamés par les instruments juridiques internationaux auxquels elle a adhéré. Malheureusement, il découle des enquêtes menées dans le milieu carcéral du territoire de Mbanza-Ngungu, que les détenus sont incarcérés dans des conditions inhumaines et dégradantes qui non seulement violent leurs droits fondamentaux reconnus et garantis par la loi mère, mais aussi les exposent à la mort imminente.

Abstract :

Article 18, paragraph 5 of the Constitution of February 18, 2006, as amended and supplemented by Law No. 11/002 of January 20, 2011, stipulates that every detainee must receive treatment that preserves their life, physical and mental health, and dignity. This reaffirms the Democratic Republic of Congo’s commitment to human rights as proclaimed by the international legal instruments to which it has acceded. Unfortunately, investigations conducted in the prisons of the Mbanza-Ngungu territory have revealed that detainees are incarcerated in inhumane and degrading conditions that not only violate their fundamental rights recognized and guaranteed by the Constitution, but also expose them to imminent death.
