La Territorialisation de la Santé au Maroc : Fondements de l’État Social, Cadre Juridique et Perspectives à la lumière des expériences Française, Allemande et Espagnole

Résumé
La territorialisation de la santé constitue aujourd’hui un axe structurant de la réforme du système national de santé au Maroc. Elle s’inscrit dans une dynamique plus large de consolidation de l’État social, de généralisation de la protection sociale et de régionalisation avancée. L’objectif n’est plus seulement de garantir juridiquement le droit à la santé, mais d’en assurer l’effectivité à travers une organisation territoriale capable de répondre aux besoins différenciés des populations.
La présente étude analyse, dans un premier temps, les fondements internationaux du droit à la santé et leur articulation avec les exigences de disponibilité, d’accessibilité, d’acceptabilité et de qualité des services sanitaires. Elle examine ensuite le cadre constitutionnel et législatif marocain, notamment l’article 31 de la Constitution de 2011, la loi-cadre n° 06-22 relative au système national de santé et la loi n° 08-22 relative à la création des Groupements sanitaires territoriaux. L’étude met en évidence les atouts institutionnels et juridiques dont dispose le Maroc pour réussir cette territorialisation.
Une approche comparative des modèles français, allemand et espagnol permet ensuite d’identifier différentes formes d’articulation entre État social, solidarité nationale, organisation territoriale et gouvernance sanitaire. L’analyse ne vise toutefois pas à transposer mécaniquement ces modèles au Maroc, mais à montrer que le Royaume dispose de caractéristiques propres susceptibles de soutenir une territorialisation adaptée à ses réalités démographiques, géographiques, sociales et institutionnelles. Ainsi, l’approche méthodologique adoptée est comme suit : il s‘agit d’étude qualitative fondée sur une analyse documentaire, juridique et comparative des cadres internationaux et nationaux, complétée par une comparaison des expériences française, allemande et espagnole. En ce qui concerne l’échantillon : il s’agit d’un corpus documentaire et juridique composé des instruments internationaux, des textes marocains et des cadres institutionnels et juridiques français, allemands et espagnols.
En ce qui L’analyse met en évidence l’existence, au Maroc, de fondements constitutionnels, juridiques et institutionnels favorables à la territorialisation du système de santé.
La mise en place des Groupements sanitaires territoriaux constitue un dispositif structurant susceptible d’améliorer la coordination, la proximité et l’efficience de l’offre de soins.
La territorialisation apparaît comme un levier de réduction des disparités territoriales, à travers une allocation des ressources davantage différenciée selon les besoins des populations.
La consolidation des soins de santé primaires, des ressources humaines et des dispositifs numériques constitue une condition déterminante de l’effectivité de la réforme.
Le renforcement de la carte sanitaire et des systèmes d’information doit favoriser une planification fondée sur les besoins réels et une régulation plus équitable de l’offre de soins.
La réforme suppose un équilibre entre la garantie nationale de l’égalité d’accès aux soins et l’adaptation territoriale des politiques et des moyens sanitaires.
La territorialisation peut ainsi contribuer à faire du système de santé un instrument de justice sociale, d’équité territoriale, de cohésion nationale et d’effectivité du droit constitutionnel à la santé.

Abstract
The territorialization of healthcare has become a key pillar of the reform of Morocco’s national health system. It forms part of a broader process aimed at consolidating the social state, achieving the universalization of social protection, and advancing the process of advanced regionalization. The objective is no longer merely to legally guarantee the right to health, but also to ensure its effective realization through a territorial organization capable of responding to the differentiated needs of populations.
This study first examines the international foundations of the right to health and their relationship with the requirements of availability, accessibility, acceptability, and quality of healthcare services. It then analyzes the Moroccan constitutional and legislative framework, particularly Article 31 of the 2011 Constitution, Framework Law No. 06-22 on the national health system, and Law No. 08-22 establishing Territorial Health Groups (Groupements sanitaires territoriaux). The study highlights the institutional and legal assets available to Morocco to successfully implement the territorialization of healthcare.
A comparative analysis of the French, German, and Spanish models then makes it possible to identify different forms of articulation between the social state, national solidarity, territorial organization, and health governance. The purpose, however, is not to mechanically transpose these models to Morocco, but rather to demonstrate that the Kingdom has its own characteristics and assets that can support a form of territorialization adapted to its demographic, geographical, social, and institutional realities.

However, the purpose of the analysis is not to mechanically transpose these models to Morocco, but rather to demonstrate that the Kingdom has specific characteristics that may support a form of territorialization adapted to its demographic, geographical, social, and institutional realities.
Accordingly, the methodological approach adopted is a qualitative study based on documentary, legal, and comparative analysis of international and national frameworks, supplemented by a comparison of the French, German, and Spanish experiences. Regarding the study corpus, it consists of a documentary and legal corpus comprising international legal instruments, Moroccan constitutional and legislative texts, as well as French, German, and Spanish institutional and legal frameworks.
The analysis highlights the existence in Morocco of constitutional, legal, and institutional foundations conducive to the territorialization of the health system. The establishment of Territorial Health Groups constitutes a structuring mechanism likely to improve the coordination, proximity, and efficiency of healthcare provision. Health territorialization appears to be a lever for reducing territorial disparities, through a more differentiated allocation of resources according to the needs of populations. The consolidation of primary healthcare, human resources, and digital health systems constitutes a decisive condition for the effective implementation of the reform. The strengthening of the health map and health information systems should promote needs-based planning and more equitable regulation of healthcare provision.
The reform requires an appropriate balance between the national guarantee of equal access to healthcare and the territorial adaptation of health policies and resources. Health territorialization can thus contribute to making the health system an instrument of social justice, territorial equity, national cohesion, and the effective realization of the constitutional right to health.
